East Area November Update


We continue to work on issues within the East, particularly around resourcing and capacity.  Where required we have initiated Health and Safety Investigations into when officer’s safety has or could have been compromised.  Unfortunately, since our last circular our members experienced terrifying situations in Edinburgh during which 2 officers were seriously injured.  We continue to work with the Service to ensure that similar incidents can be avoided in the future and that safety and welfare remains at the forefront of considerations.

We are approaching the Festive season, we are already acutely aware of the impact events have on officers particularly the use of Red Days, adjustment to rest days and increased workload.

On 1st December, overtime for Constables and Sergeants will commence immediately at the end of shifts, for the first time in almost 25 years there is no need to deduct the first half hour from claims.

We look forward to seeing the benefits within the Service of not paying VAT, which will improve cash within the service by over 25 million per year.  The roll out of TASER across the country is the start of increasing safety and options available to officers, it was used effectively this week to tackle 2 armed robbers who threatened officers with knives.



The abolition of the deduction of payment for toil for the first four occasions of casual overtime in any week is effective from Friday 1st December 2017.  From this date, please ignore the section of SCOPE which states planned or unplanned overtime, there should be no deductions from overtime claims as of Friday.


Any queries or questions in relation to overtime or other element of Regulations should be referred to a local SPF representative, the local office or via the SPF contact portal where suitable advice can be given to individual circumstances.


There are only 2 Public Holidays within Police Regulations, Christmas and New Years Day.  Where an officer is required to work on either of these days they are entitled to be compensated at double time overtime, where they receive less than 8 days notice of this requirement, they are entitled to the overtime and another public holiday.

If an officer is rostered to be rest day on either of the above dates they will receive a re-rostered rest day as the public holiday takes precedence.


The Chief Constable has the ability to recall an officer to duty at any time or to require that officer to perform duty on a rest day, public holiday or annual leave day.

A duty roster must be prepared for each officer, it must detail

  • daily duty (start and finish) times
  • rest days and public holidays
  • must cover a 3 month period (13 weeks)
  • must be provided to the officer at least 1 month in advance (4 weeks)
  • must have 11 hours between shifts

A duty roster can be altered only where:

  1. It is at the officer’s own request, or
  2. It is agreed by the Joint Central Committee, or
  3. Where there is an exigency of duty, or
  4. In the case of a part-time officer, where it has been agreed between the officer and the Chief Constable.

Changes to rosters should only be made after full consideration of wellbeing, operational and practical circumstances rather than purely on financial grounds. This consideration should be demonstrable.

The term “exigency of duty” should be interpreted as relating to a situation where a pressing demand, need or requirement is perceived that is not reasonably avoidable and necessitates a change of roster. In this context the word “pressing” relates to the expected situation at the time when the duty is to be performed rather than the time when the duty roster is changed, i.e. the reasons for a change may be known many months in advance but still be pressing.

An exigency should not arise from poor planning or from organisational mistakes, examples would include unforeseen public order situations, unforeseen court attendance.

Where an exigency of duty arises, an officer should be told as soon as the requirement for the change is known and in any event 24 hours before the changed or the original starting time of the period of duty, whichever is the earlier. The exception to this is unforeseen court attendance where the notice period shall be a minimum of 12 hours before the changed or the original starting time of the period of duty, whichever is the earlier.
